Voluntary refusal in the attempt of a crime: theoretical and practical aspects

The present article concerns one of the most important institutions of criminal law - voluntary refusal to commit a crime. The paper analyzes the legal nature of voluntary refusal, its distinction from an attempt to commit a crime, and the criteria on the basis of which a person is exempted from criminal liability. Special attention is paid to the factor of voluntariness and the difference between a completed and an unfinished attempt, which is supported by practical cases. The forms of voluntary refusal, its features in the case of complicity, and problematic issues in practice are also discussed.
